1. Purpose of using Data

Harton Incorporadora Ltda, registered with the CNPJ under nº 41.767.257/0001-50, with headquarters established at Rua General Goes Monteiro, 394, Room 204 in the city of Bento Gonçalves, RS (owner of the brand cabanaurban) together with its partner in the Village Planalto urban cabin complex, Elite Participações Ltda, the purpose of this Privacy Policy is to demonstrate the commitment to protecting your privacy and seek the best corporate governance practices, in a transparent manner, the data that may be collected, used, stored and shared by Harton Incorporadora Ltda and Elite Participações Ltda and their employees, with the aim of registering customers on our platform so that we can send quotes for travel services or promotions, formalize the short or medium-season rental intermediation contract with our customers, respond to complaints, queries and other relevant information regarding accommodation.

We do not share your data with third parties.

Please read this Privacy Policy carefully and if you do not agree with any terms, you must immediately stop using the services and cancel your registration. 2. Who does this Policy apply to?

This Policy applies to users of the website (www.cabanaurbana.com) as well as to all Cabana Urbana customers.

3. What personal information do we collect?

In order to provide a specialized service to you, we need to collect personal information and data when a user requests a reservation, signs up for our newsletter, which allows us to identify people, such as: name, email address, telephone and/or cell phone number , home address, date of birth, birthplace, nationality, marital status, gender, company affiliation, job title, banking information such as credit and or/debit card details, social media account information, when you voluntarily share photos or profile videos or posts of your experience with us, information about your comment (feedback), for your safety, images and visual recordings through the use of closed circuit television systems (in common use, condominium locations) collected during a visit to dependencies of the urban cabin complexes, when permitted by applicable law, identity or official identification number and/or other data subject to future use.
Through this personal data, for example (e-mail), electronic communications between our company and the user of the website may take place, with the sole objective of disseminating communications and offers of our products/services.
At any time, the user may stop receiving such communications by requesting it through our service channels.

4. How long is personal data stored?

Personal data is stored only for as long as necessary to fulfill the purposes for which it was collected, unless there is any other reason for its maintenance, such as compliance with any legal, regulatory, contractual obligations, among others, from that are based on a Legal Basis. Of course, you always have the right to request data deletion.

As our facilities do not allow children in accommodation, but teenagers over 14 years of age, we collect the following data from teenagers: Full name, age, personal data to register on the website for simulation and/or reservation/purchase of stays and this collected data is used exclusively for the following purpose:

Teenagers' personal data is necessary to confirm personal identification with the minor's legal guardians at the time of booking the stay.

We are always seeking to improve our business and services, this Policy may be periodically updated and therefore, it is your obligation to check this content whenever you access the urban cabin website.

You will not be able to remove watermarks (if any) or copyright notices present in the Cabanaurbana Content.
The User undertakes to use the Website respecting and observing these Terms of Use, as well as current legislation, customs and public order. In this way, the User agrees that they will not be able to:

2.1 Illicitly access the Website or third-party computer systems related to the Website or Cabanaurbana, in any form or by any means;

2.2 Disseminate computer programs or viruses capable of causing damage of any nature, including to equipment and systems belonging to Harton and Cabanaurbana or third parties;

3.1 Cabanaurbana is a brand registered with the National Institute of Industrial Property (INPI), whose owner is Harton Incorporadora Ltda.

3.2 For the purposes of these Terms of Use, the term "Trademark(s)" means all registered trademarks, logos, service marks and domain names, or other indications of origin now or hereafter used by Harton.

3.3 Nothing here guarantees permission to use any trademark registered by Harton other than as expressly described in these Terms of Use.

3.4 You agree that you will not use Harton's trademarks in any way that may disparage, damage its image or give a poor impression of it.

3.5 You agree not to use any Harton trademark or any trademark variation (including misspelled variations) as a domain name or part of a domain name regardless of the domain type, or as a meta tag, keyword or any type of computer programming code or data.

3.6 You may not, at any time, adopt or use, without Harton's prior consent, any word or mark that is similar to or that could be confused with Cabanaurbana's trademarks.

3.7 The look and appearance of the cabanaurbana website, including all page headers, individualized graphics, button icons and scripts, are registered trademarks of Harton and may not be copied, imitated in any way, in part or in full, without authorization from written by Harton.

3.8 All other trademarks of business partners, product names or company names or logos used or appearing on the Cabanaurbana website are those of their respective owners.

Harton and Cabanaurbana use their best efforts to inform, serve and protect the User. The User is solely responsible for the use of the Site, its tools and functionalities. In no event will Harton or its directors, representatives, agents, employees, partners, partners or service providers be liable for any consequential, indirect, punitive or expiatory damages, lost profits or other monetary losses related to any claim, lawsuit or other procedure taken in relation to the use of the Website, its content, functionalities and/or tools. Cabanaurbana provides a Call Center to receive all communications that the guest wishes to make. The Center operates through the communication channels listed below:

9.1 In person, at the Central Office, during opening hours;

9.2 By telephone 54 99239-6629, from Monday to Friday from 9am to 11:45am and from 1:30pm to 5:45pm, except holidays;

9.4 By correspondence addressed to Harton Incorporadora Ltda at Rua General Goes Monteiro, 394 - Sala 204 - Bairro São Francisco - Bento Gonçalves – RS CEP 95.703-080, always accompanied by the consumer's contact information, so that we can return service. Harton may communicate with the User through other means of communication, such as cell phone, Whatsapp, SMS, or physical correspondence. We will do our best to answer your questions as quickly as possible.

10. Updates to these Terms of Use

Harton Incorporadora Ltda may review, improve, modify and/or update, at any time, any clause or provision contained in these Terms and Conditions of Use or in the Policies. The updated version will be valid for use of the Site. 11. Applicable Law and Venue of Election

The cabanaurbana website is controlled, operated and administered by Harton Incorporadora Ltda in the city of Bento Gonçalves - RS, and can be accessed by any device connected to the Internet, regardless of its geographic location. In view of the differences that may exist between local and national legislation, when accessing the Website, the User agrees that the applicable legislation for the purposes of these Terms of Use will be that in force in the Federative Republic of Brazil. Harton Incorporadora and the User agree that the Court of the District of Bento Gonçalves - RS, Brazil, will be the only one competent to resolve any issue or controversy arising or resulting from the use of the Site, expressly renouncing any other, however privileged it may be, or come to be.

1. Check-in and Check-out (Entry and Exit)

1.1. Accommodation starts at (3:00 pm) and ends at (12:00 am) as requested at the time of booking;
1.2. Arrival before (3:00 pm) must be communicated to the Manager in advance and will be subject to space availability;
1.3. Departure before (12:00 am) must be communicated in advance to the Manager, and will not entitle the guest to any type of refund or refund;
1.4. Exceeding the check-out limit (12:00 am), if there is another guest waiting to enter the accommodation, half the amount of the contracted accommodation will be charged if it occurs before (3:00 pm), after this time, the full contracted amount of the daily rate;
1.5. When checking out, the guest must leave the vehicle gate remote control in a specified location inside the cabin;
1.6. Upon departure (check-out), the cabin will be inspected, and if any stains are found on the linen items (sheets, pillowcases, blankets, towels, blankets, duvets), which have been used to clean shoes, paintings hair, blood stains, grease, etc..., the value of the item will be charged for replacement, in order to maintain the same standard of quality and products for other guests;
1.7. Also at check-out, if after the inspection, any piece of furniture or decoration is found to be damaged, the replacement value of the item will be charged;
1.8. If at check-out time, no item belonging to the cabin is found, the guest's account will be charged;
1.9. When checking out, the guest must leave the vehicle gate remote control in a specified location inside the cabin;
1.10. When leaving (check-out), the guest must leave the air conditioning turned off with the remote control inside the cabin and leave all windows and doors closed and locked.

2. Cancellation of reservations or rescheduling

For payment by advance deposit
2.1. For cancellation or rescheduling up to 30 days before the check-in date, 100% of the amount corresponding to the deposit to confirm the reservation will be refunded;
2.2. For cancellation or rescheduling between 7 and 30 days before the check-in date, 50% of the amount corresponding to the deposit to confirm the reservation will be refunded;
2.3. For cancellations or rescheduling less than 7 days before the check-in date, there will be no refund of the amount paid;
2.4. The refund of the amount paid will be made within 10 working days after the cancellation request is made via email;
*Bank transaction fees will be deducted, if any;

For payment via/through credit card (in installments)
2.5. For cancellation or rescheduling up to 30 days before the check-in date, 90% of the amount paid for the deposit to confirm the reservation will be refunded, 10% will be deducted for fees (card operators + advance payment);
2.6. For cancellation or rescheduling between 7 and 30 days before the check-in date, 50% of the amount for the deposit to confirm the reservation will be refunded, 10% will be deducted for fees (card operators + advance payment);
2.7. For cancellation or rescheduling less than 7 days before the check-in date, 100% of the amount paid will be retained by the Cabanaurbana Manager;
2.8. To return the amount paid, it will be done within 10 working days after the cancellation request is made via email;

General rules
*The cleaning fee and breakfast booking will always be refunded 100% of the amount, regardless of the cancellation period;
*The deadline for cancellation will be counted from the date of formalization of the cancellation via email.

3. Accommodation prices and fees

3.1. We work with fluctuating accommodation prices according to market demand.
 

4. Payment methods

4.1. For payments made via credit card, the reservation will be made after confirmation of payment in accordance with the card operator;
4.2. For payments made via PIX, it will be necessary to send proof of payment, via WhatsApp (54) 99239-6629 Laura or to email: reservas@cabanaurbana.com, to confirm the reservation.

5. Children and teenagers

5.1. In accordance with our target audience, we receive teenagers aged 14 and over accompanied by one of their parents, in accordance with Federal Law nº 8,069, of 07/13/1990 (art. 250 of Law nº 8,069, of July 13, 1990 ), who will count as adult guests in the tariff. Hosting a foreign minor must respect the same established standards and follow the laws in force.

*The legal guardian of the teenager must present their identification document, which proves the degree of kinship required at the time of booking, and they must be the father or mother.

6. Parking

Cabanaurbana One parking (each cabin has its own designated space)
6.1. Parking is complimentary, has a closed and covered patio, for a medium-sized vehicle (car, truck, SUV), or motorcycle and is not covered by insurance;
6.2. When parking the vehicle inside the parking lot, the guest must respect the limit of their space marked on the ground, so that other guests can park their vehicles;
6.3. For the safety of our guests and their vehicles, Cabanaurbana One has 06 (six) monitoring cameras for the parking lot, vehicle gate and pedestrians, and another 03 (three) cameras in the cabin access corridor, and these operate 24 hours a day and 7 days a week and images are protected by law;
6.4. The vehicle gate automatically closes after 1 minute with an anti-crushing sensor, pay attention to this time to avoid damage to your vehicle;

Cabanaurbana Village Planalto parking lot (rotating and no defined space)
6.5. Parking is complimentary with a closed patio and no cover for a small and medium-sized vehicle (car, truck, SUV), or motorcycle and is not covered by insurance;
6.6. When parking the vehicle inside the parking lot, the guest must respect the limit of their space marked on the ground, so that other guests can park their vehicles;
6.7. For the safety of our guests and their vehicles, cabanaurbana Village Planalto has 08 (eight) monitoring cameras for the parking lot, the vehicle and pedestrian gate, and another 02 (two) cameras in the external corridor accessing the cabins, and these work 24 hours a day and 7 days a week and images are protected by law;
6.8. The vehicle gate automatically closes after 30 seconds with an anti-pinch sensor, pay attention to this time to avoid damage to your vehicle.

7. Forgotten objects

7.1. As soon as you realize that you have forgotten something inside the cabin, inform the Manager immediately, preferably via a call or Whatsapp message via the Whatsapp contact channel (54) 99239-6629 Laura to speed things up. The same request can be made by email, via email at reservas@cabanaurbana.com;
7.2. Detail the appearance of the object in writing to make it easier to find and so that the cleaning team does not confuse it with objects discarded by guests;
7.3. Objects forgotten inside the cabins will be kept by the manager for a maximum period of 90 (ninety) days from the check-out date. After this period, the cabinaurbana manager will forward the object for donation;
7.4. To send forgotten objects inside the cabins, via the Post Office, the Post Office shipping fee will be charged plus a fee of R$ 100.00 for the Manager to carry out the shipping.

8. Visits to the huts

8.1. Access to the cabins is only allowed to duly registered guests, we do not allow visits;
8.2. We confirm that the maximum capacity of our cabins is 2 people.

*Failure to comply with this rule will result in a charge of 1 additional night.

9. Guest Guidelines

9.1. The cabins have a safe, when leaving, avoid leaving valuables or money outside, as they are your sole responsibility;
9.2. If the vehicle gate remote control is not returned, the guest's account will be charged the amount of R$ 150.00 to replace it;
9.3. Cabanaurbana does not make reservations or any transactions through social media or suspicious channels. Information will always only be sent via the official email: (reservas@cabanaurbana.com) via WhatsApp (54) 99239-6629 Laura or via the official website (www.cabanaurbana.com);
9.4. The voltage of our electrical network is 220V (Voltz), DO NOT USE electrical appliances below this voltage;
9.5. When leaving the cabin, make sure you have locked the windows, turned off the air conditioning, turned off the taps and closed the door;
9.6. Money or valuables left on the cabin premises are the sole responsibility of the guest owner;
9.7. Each cabin has its own WIFI password, which is specified in a specific location within the units.

10. Of prohibitions

10.1. All of our accommodation complexes were designed so that the guest has as much privacy and security as possible, therefore, all access gates for common use and internal doors of the cabins have a SELF CHECK IN access system, where they have electronic locks to which are provided with random access passwords (they are never the same passwords for new guests) and with a view to this security, the guest should never provide such passwords to strangers, as this violates their security, as well as that of other cabin guests;
10.2. SMOKING IS PROHIBITED inside cabins, bathrooms, open balconies, areas and corridors for common use by guests in accordance with the changes brought about by article 49 of Law No. 12,546/2011 and by Decree No. 8,262/2014, which regulates it, since December 3, 2014 that it is prohibited to smoke cigarettes, cigars, pipes, hookahs and other tobacco products in places of collective use, public or private, throughout the country, if this rule is violated, a hut cleaning fee will be charged in the amount of R$ 200.00;
10.3. It is not permitted to hang clothes on windows and balcony railings;
10.4. The carrying or use of weapons of any kind on the cabinaurbana premises is prohibited;
10.5. The use of incense, wax candles, or any other types of materials that generate flames is not permitted (only electronic candles are permitted);
10.6. IT IS EXPRESSLY PROHIBITED to take photos or film footage for use with the purpose of defaming or denigrating the brand or image of the cabanaurbana complexes;
10.7. It is not permitted to take photos or videos of the parking lot in which the license plates of other guests' vehicles appear, unless the image of the license plates is blurred so that they do not appear;
10.8. In common areas, avoid taking photos or filming in which the faces of other guests appear; by doing so, you will be giving other guests the right to privacy;
10.9. Use a cleaning or maintenance professional to carry out private services;
10.10. It is not permitted to remove any items from the cabin for external use.

11. Pets

11.1. We do not allow pets inside the cabins or in common areas.

12. Ironing clothes with an electric iron

12.1. IT IS PROHIBITED TO IRON CLOTHES with an electric iron inside the cabins, if the guest needs it, we have a steam iron available in each cabinaurbana complex, just ask the Manager through the WhatsApp service channel (54) 99239-6629 Laura.

13. No Show

13.1. In case of no-show for the reservation made by email, telephone, WhatsApp or Cabanaurbana website, the guest must pay the total price of the reservation (100%) already deposited in advance;
13.2. For no-shows for reservations made online through Booking, airbnb, travel agencies and other online booking applications (OTAs), the guest will be charged the total price of the reservation.

14. Private wine cellar

Cabanaurbana has a private cellar with several world-award-winning labels from renowned wineries here in the region available to its wine-loving guests.
How does the consumption of these products work?
14.1. For the guest to know the value of each product for consumption, simply access the Cabana Urbana website, (www.cabanaurbana.com) in the top menu click on (Private Cellar), there you will find the partner wineries and the wines and sparkling wines from each one with their respective values, technical descriptions and method of making payment;
14.2. For any questions regarding the payment method, please contact the Manager (54) 99239-9929 Laura.

15. Cooking inside the huts

15.1. IT IS STRICTLY FORBIDDEN to use stoves, stoves, portable fireplaces, or any other objects that generate flames inside the cabins;
15.2. Our region is very rich in gastronomy, which is why the Cabanaurbana complexes do not have a stove or cooktop, this way guests can make the most of their stay by exploring the best restaurants and cuisine in the city.

16. Force majeure situations

16.1. Situations caused by force majeure, such as windstorms and environmental disasters that cause interruption of the electrical network, water supply, telephone line and internet are not the responsibility of cabanaurbana.

17. Tourist information

17.1. For tourist information, services, tours and suggestions, we ask that you contact the Manager via the Whatsapp contact channel (54) 99239-6629 Laura, we will be available to help.

*The city has several Tourist Information Centers located at strategic points, or guests can access the website https://bento.tur.br/ where they will find a lot of information related to this subject.

18. Towels and bath mats

18.1. Cabanaurbana provides a kit of towels and bath mats (Trussardi) per cabin containing:
- 02 bath mats (one is in front of the bathtub and the other in the bathroom)
- 02 Bath towels 
- 02 Bathrobes
- 01 face towel

19. Bedding

9.1. Cabanaurbana provides one bedding kit (Trussardi) per cabin containing:
- 01 Sheet
- 01 On sheet
- 04 pillowcases
- 01 Duvet
- 01 Blanket (it is stored inside the bench/trunk in front of the TV at Cabanaurbana Village Planalto and in the closet at Cabanaurbana One)

*It is prohibited to use towels or bed linen outside the Cabanaurbana complexes.

20. Changing towels, cleaning and tidying

For your convenience, we provide the complete Trussardi brand bed and bath linen during your stay.

20.1. Stays of up to 4 days
For stays of up to 4 days, a set of bed and bath linen will be provided from the moment of check-in.
Important: If you want an extra change to be made during the 4-day period, an extra fee of R$70.00 will be charged for the complete change of bed and bath linen.

20.2. Stays longer than 4 days
For stays longer than 4 days, we offer a change of bed and towels at no extra cost. We will agree on the date and time for collection and delivery of the new parts.

*Damages: All bed and bath items are carefully sanitized and made available for use by cabin guests. If damage of any nature is found (holes, tears, stains that do not come out in the wash), the monetary value of the damaged item will be charged, in accordance with the market value.

21. Laundry

21.1. For laundry services (personal clothes), the guest must request the service directly with the laundry through the WhatsApp service channels (54) 99929-9130 Lariane or (54) 99989-9130 Ricardo, as the cabinaurbana laundry is outsourced.

22. Breakfast

22.1. At Cabana Urbana, you can enjoy a delicious breakfast when you make your reservation. This option is available at an additional cost, which will be advised at the time of booking.
22.2. If you didn't sign up for this service when booking, don't worry!
Upon arrival, you can order breakfast through our customer service line: (54) 99239-6629. 
22.3. Our breakfast is provided by a partner hotel, and to enjoy it, we ask that you go to the address: Rua Herny Hugo Dreher, 197. For those who choose breakfast, a voucher will be made available inside the cabin. Just show it up at the hotel to taste the delicacies prepared with great care!
